Section 1983 of the Civil Rights Act of 1871, 42 U.S.C. ยง 1983, can be a valuable tool for the vindication of constitutional rights in land use cases because it is liberally construed to promote its remedial purposes. The following discussion is intended to provide a general overview of the issues that a land use practitioner is likely to encounter in Section 1983 litigation.
